Nota de prensa de la Asociación de Trabajadores de SINTEL

Esta Asociación que representa a 1.700 trabajadores - afectados por la quiebra fraudulenta de la empresa española "SINTEL" en el año 2001, quiere INFORMAR:

1.      La empresa estadounidense "Mas Tec Inc" que cotiza en el "Nasdaq" y cuyo Chairman es D. Jorge Mas, tiene abierto en España un procedimiento PENAL y un requerimiento para que se persone ante la Justicia Española y no lo está cumpliendo.

2.      D. Jorge Mas y su hermano Juan Carlos (hijos del fallecido Jorge Mas Canosa, que fuera Presidente de la Fundación Nacional Cubano Americana)  por su actuación DELICTIVA, en complejas operaciones de ingeniería financiera, a través de empresas filiales radicadas en paraísos fiscales. La Fiscalía Anticorrupción de España, solicita 5 años y medio de PRISIÓN y una fianza de 300.000.000 euros; existiendo una resolución judicial de requerimiento para que comparezcan sin excusas o pretexto alguno ante el JUZGADO  en España y no lo están cumpliendo.

3.      Ante este comportamiento la Fiscalía Anticorrupción de España interesa al Juzgado Central de Instrucción  Nº1 de la  Audiencia Nacional, que dicte AUTO de Detención Internacional contra D. Jorge Mas Santos para que se persone ante la Justicia Española.

4.      La Justicia Española ha librado varias Comisiones Rogatorias a EE.UU, negándose las autoridades estadounidenses a ejecutarlas en los términos solicitados por España. La última de ellas, aún no ha sido contestada.

5.      El día 26 de marzo de 2012 la Sala Segunda de lo PENAL de la Audiencia Nacional de España dictó AUTO señalando para los días 14 y 15 del próximo mes de junio el inicio del JUICIO ORAL.

6.      En el juicio declararán un centenar de testigos, un gran número de ellos a petición de la Fiscalía Anticorrupción entre los que se encuentran cinco máximos directivos de TELEFONICA ESPAÑA (Movistar) entre ellos Juan Villalonga que fue presidente de la compañía entre 1996 y 2000.

Esta Asociación, después de 11 años, espera que se haga justicia y si los acusados estadounidenses no se presentan al JUICIO ORAL en España, pediremos a la Audiencia Nacional Española que solicite a EE.UU su EXTRADICIÓN.

Our association, representing 1.700 workers affected by the speculative and fraudulent bankruptcy in 2001 of the Spanish Company SINTEL, former subsidiary of TELEFÓNICA DE ESPAÑA, (Movistar nowadays),

REPORTS:

1.      On 14 and 15 June 2012 a trial in the Criminal Division of the Spanish National Courthouse, in Madrid, will begin to judge eight top executives from SINTEL accused of "corporate crime, punishable insolvency and crime against the Treasury".

1.      Four out of the eight defendants are American. The brothers Jorge and Juan Carlos Mas Santos. Both are Jorge Mas Canosa's sons, the late exiled Cuban businessman in the U.S.A., who in turn was "President of the Cuba-American National Foundation". The other two American citizens are Joel Tomás Citron and José Miguel Sariego.

1.      They are charged for their CRIMINAL conduct in complex financial engineering through subsidiaries located in tax heavens, responsible for emptying the assets of SINTEL and its subsequent bankruptcy. The Anti-Corruption Prosecutor and the Private Prosecutions are asking for five years and six months imprisonment for them, and €300 million.

1.      The National Court is pointing out to the U.S. Company "Mas Tec Inc." (owned by Mas Canosa family), listed on the NYSE (Nasdaq) and which was instrumental in the purchase of  SINTEL, as being the "only located one" from the three companies considered responsible for that. Spanish Justice continues demanding information through Rogatory Commissions sent to the U.S.A.

1.      About a hundred witnesses will be declaring in Court. Many of them are requested by the Anti-Corruption Prosecutor, among which are five top executives of Telefónica de España (Movistar), including former presidents Cándido Velázquez and Juan Villalonga (1996-2000)

Our association, after 11 years, is longing for justice and will ask the Spanish National Court to request the extradition of the American defendants in case they don't attend the trial.
